You have a great idea and think it can make you millions. You start the application process with a Patent Attorney and invest thousands of dollars; only to find out the idea has been on the market for years. Had you done your homework using the free patent tools available on the internet, you would have found this out before ever spending a dollar!

Regarding patent costs, some patents may cost more than 0, depending on the nature of the project and the scope of the research needed to obtain the patent. However, don’t let the numbers stop you from making your dream become a reality.

Other patents can be obtained quickly and inexpensively; thus, turning your dream into a reality faster than you ever imagined! Regardless of the outcome of the process, here are a few factors to keep in mind:

4. Dolcera Conclusion Indians have always cherished their traditional knowledge, heritage and culture. Neem is one such heritage and an integral part of our socio-economical culture. From times immemorial Neem has found use as an intergradient in Indian culinary, as a medicine for cure of several allergies/diseases and in various religious ceremonies across the country. Time and again there has been a hue and cry to stop other countries from patenting this age old Indian knowledge of Neem. This study, is aimed to answer the key question Are Indians holding an upper hand, legally too, on Neem usage? Comparing the trend of patent filing in India and US between 2006 to June 2009, we can safely conclude that India as a whole has risen up to the expectations and has filled 98 patents on technology surrounding Neem. CSIR (India) played a key role here in India as well as in US to remain as top assignee in the terms of number of patent fillings on application of Neem. However, the complete picture can be alarming. Figure this, despite CSIR remaining as the top assignee, patents on Neem in India are mostly held by individuals (41.84%), followed by private sector, 31.63%. Government institutes (which included CSIR, DRDO, ICAR, IIHR etc) lagged behind all and retain only 26.53% of patents on India’s traditional asset. While Indians have used Neem for its medicinal benefits such as for wound healing, diabetes, HIV/ Aids and skin care; US assignees looked more interested in the areas such as Biodesel production, fertilizers, dental formulations, food packaging, pharmaceutical compositions etc. This study was aimed to gain in depth insight of patenting trends on Neem in India and US. Waking up to the cause, India has done well to broadly cover the Neem application areas but the efforts should increase exponentially to retain the legal rights on Neem, the gift of nature to India

There is a balance between industries and common every day folk across all walks and aspects of life. There is no doubt about it, big corporations have become very powerful. They have developed influence in the political arena as part of their power structures.

Therefore, you have an industry that manufactures drugs. Maybe, as rumour has it, they have wrapped their arms around a certain government regulatory agency. Who knows? With this power, they can spend money on research and get ‘approved’ by this regulatory agency. Then they can market their prescription medications for outrageous prices.

Yet, the natural remedies that currently exist, such as natural remedies for arthritis, have no such champion with big purse strings. In fact, many of the big prescription drug medications are nothing more than concentrated, synthetic and slightly different copies of compounds that naturally exist in nature.

So, therefore, regular remedies, like acid reflux natural remedies, that grow in the forest, desert or perhaps even in one’s backyard can’t get the stamp of approval from this unnamed government agency, as a substance that is proven to have a positive effect on health.

It’s rather funny when you think about it. But then, nature was there before any government and nature will be there after. Interesting isn’t it? Nature doesn’t seem to require government approval.

But we spoke of a balance a few moments ago. The power definitely seems to rest on one side of the equation. But what is happening on the other side? Alternative healers, old books, and folk wisdom passed down through the ages are still out there and from them, many people learn to apply natural healing methods (that don’t have that big stamp of approval from an authoritarian agency) to solve their health problems. Because the costs of getting ‘official’ treatment and officially approved prescription meds now make the cost of getting said treatment beyond the reach of many.

In other cases, some people just know about simple things that work and they seem to work better, cost less and cause less trauma to the human body when implemented than the results derived from going through ‘official’ channels. If you are a person who doesn’t have unlimited wealth, what way are you likely to go?

Next, learn more about: herbal remedies and others as well!

Embrace and preserve the natural healing choices that have alway been with us.

Intellectual Property: How to Review a Patent Application

All the new inventions that are marketable and are expected to make profits must be protected and an online patent attorney is the best person to help you get that protection.

You have successfully come out with a new invention. You are sure that your invention is going to create a good market and fetch you profits. There is a great chance that your idea can be copied and misappropriated by others. To safeguard your invention from such misuse, get it patented with the help of an online patent attorney.

The invention must be novel

Being novel means that it can not be known by others or used by others before the inventor claims to have invented it.  It also means that the invention can not be patented or publicly disclosed before the inventor’s claimed invention.   The patent must be applied for within 1 year after public disclosure or use.

Any inventor can apply for a patent- either directly or through a patent attorney. Applying and getting it is a mind-numbing process. It may take years to get your application cleared. Seeking the help of an experienced lawyer to deal with such cases will prove beneficial. It will reduce the cost and time of acquisition.

However a toy car that transforms into a robot is not an obvious extension of a red toy car.

The invention must be described simply and completely, so a skillful person could duplicate it

A person with skill in the knowledge area must be able to understand the invention completely, in order to have it to be patentable.  If fear of having the invention stolen motivates the inventor to leave out essential elements of the invention, then it is not patentable.  This person would be better served by keeping the invention a trade secret.

  • No need to construct an expensive physical prototype.
  • The ability to evaluate the concept under a wide range of ‘what if’ scenarios, much more rapidly and far cheaper than would be the case with real-life testing.
  • Simulations of your invention are likely to highlight shortcomings or positive aspects not previously considered.
  • The results of simulations facilitate the drafting of realistic specifications.

Being able to deliver proof of concept and specifications for your invention would probably improve your chances of securing funds or finding a manufacturer. If the idea of modelling and simulation is foreign to you, then you may want to consider employing the services of a modelling and simulation consultant. Including this step in the process would significantly reduce any uncertainty that you or anyone else may have about your invention.
